Terms and Conditions

1. Promoter’s Details: Mariner International Travel (UK) Limited, a member of the Travelopia Group of companies. Registered office: Origin One, 108 High Street, Crawley, West Sussex, RH10 1BD. Registered in England with company number 1239190.

2. Eligibility: This competition is open to anyone resident in the UK who is eighteen (18) years of age or older. We reserve the right to ask for proof of age, residence or eligibility. Employees and immediate family (defined as parents, children, siblings, spouse and life partners) of the Promoter or its affiliates, subsidiaries, advertising or promotion agencies are not eligible to enter this competition.

3. How to Enter: To enter the competition you must complete your details on the entry form on https://www.moorings.com/uk/motorboat-and-yachting-competition. This will require you to insert your first name, surname, email address and mobile telephone number and then confirm your entry by pressing the “Submit” button on the registration page. No entries from agents or third parties will be accepted. Incomplete entries will not be accepted. Entries will only be accepted if they comply with all entry instructions. You may only submit one entry to this competition.

4. Use of Data: All details provided by you will be held by the Promoter and used in accordance with these Terms and Conditions and the Promoter’s Privacy Policy available at https://www.moorings.com/uk/privacy.

5. Dates: The competition opens at 9am (BST) on Monday 2nd September 2024 and closes at 17.00 pm (BST) on Sunday 22nd September 2024. All entries must be received by 17:00 pm (BST) on the end date.

6. Receipt of Entries: The Promoter cannot be held responsible for network, computer or software failures of any kind, which may restrict or delay the sending or receipt of your entry. The Promoter is not responsible for entries not received and/or any lost entries. The Promoter reserves the right (in its absolute discretion) to reject entries and disqualify entrants, including without limitation where the Promoter has cause to believe that (i) there has been a breach of these Terms and Conditions or (ii) the entrant has interfered with the fair running of this competition, including, without limitation, by manipulating entries or the results, or has provided false information or has acted unethically in any other way.

7. Prize(s): Details of the prize for entering this competition are contained within Schedule 1 to these Terms and Conditions (the“Prize”). Anything which is not expressly set out in Schedule 1 is not included within the Prize. IMPORTANT: The Prize is not transferable. The Prize cannot be awarded to any person who, for any reason, would not be allowed by law to purchase or use the Prize. No compensation will be payable by the Promoter if the winner is unable to use the Prize as stated.

8. The Prize must be booked by no later than 4.00 pm (GMT) on 31 December 2024. It is the winner’s responsibility to check all details of the booking and ensure all visa and passport requirements are fulfilled and to arrange their own travel insurance. For the avoidance of doubt the entirety of the Promoter’s booking terms and conditions apply to the Prize, see USC233.pdf (mooringsnet.com) (“Booking Conditions”)for full details. The Prize may be subject to additional terms and conditions imposed by the Promoter or any other organisation in connection with this competition.

9. As per the Booking Conditions, if the Prize winner, or any member of their party, does not have the necessary experience and qualifications to skipper the yacht, then it will be a mandatory requirement to include a skipper in the booking. The winner, or at least one member onboard with the winner, must have a minimum valid qualification of International Certificate of Competence (ICC) or RYA Day Skipper (or an internationally recognised equivalent) to sail without a skipper. Proof of qualifications and experience will be requested and the winner shall not be entitled to use the Prize without providing the necessary information or documentation requested by the Promoter before the departure date of the booking.  

10. If the winner is not able to comply with the requirements of paragraph 9 above, the decision of which shall remain the sole discretion of the Promoter, then the Prize shall include a skipper and the applicable gratuity for the skipper.

11. The winner is not allowed to sell, transfer, or auction the Prize on to a third party and no alternative will be offered.

12. The Prize does not include any other transportation not listed in Schedule 1. It is your responsibility to get to and from the point of embarkation / disembarkation. We strongly advise that you do not book any separate transport arrangements unless and until we have confirmed your booking. The Promoter shall not be responsible for, or provide any refund of, any transport arrangements that you book separately and prior to confirmation of the holiday booking.

13. The winner must ensure that they and their guests hold passports that are valid for travel on the selected dates and that they and their guests are not subject to any restriction which may impact their ability to travel. If you have any accessibility requirements, please inform the Promoter as soon as possible.

14. The entirety of the Booking Conditions apply to the Prize, see the Booking Conditions for full details. The Prize may be subject to additional terms and conditions imposed by the Promoter or any other organisation in connection with this competition. The winner and any guests who travel with the winner must review and comply with these terms and conditions in order to utilise the Prize.

15. Selection of winner: The winner will be chosen at random from all valid entries of the competition.

16. Notification: The draw for the Prize shall take place on 27th September 2024. The winner shall be notified at on Thursday 29th September 2024 with instructions on how to claim their prize. The accuracy of any email address, address or phone number (as applicable) provided is the responsibility of the entrant. If a winner cannot be contacted or is unable to accept their Prize, the Promoter reserves the right to choose another winner from the eligible entries received. We shall make all reasonable efforts to contact the winner. Acknowledgement of the Prize by the winner must be received by the Promoter by 2pm (GMT) on Thursday 12th October 2024. Should the Promoter not receive confirmation from the winner by this time, or in the event that the winner or substitute winner is unreachable or ineligible or declines to accept the Prize, or a substitute winner fails to acknowledge the Prize as specified by the Promoter, the winner or substitute winner shall forfeit the Prize and the Promoter reserves the right to award the Prize to another eligible entrant, picked by random from the remaining entries. The Promoter has no responsibility to anyone who has not responded in accordance with these Terms and Conditions.

17. Winner details: Details of the winner(s), surname and county of residence, will be obtainable after 17th October 2024 by writing to the Promoter’s address specified in paragraph 1 above quoting ‘Winner: Moorings Motorboat & Yachting Competition’. The winner may be required to participate in post-competition publicity.

18. General: The Promoter reserves the right to amend the competition in exceptional circumstances. All entrants agree to abide by these Terms and Conditions and the Promoter reserves the right to exclude entrants for any breach of these Terms and Conditions. The Promoter’s decision is final, and no correspondence will be entered in to.

19. The Promoter may use photographs, names, ages and the town/city of the winner in future publications and publicity, and may require the winner to take part in promotional publicity as specified by the Promoter, including without limitation being filmed, interviews, photoshoots etc. By entering the competition, in consideration of the Promoter providing the competition and the Prize, the winner agrees to take part in such publicity and grants a worldwide, irrevocable, unconditional and royalty-free licence to the Promoter and all necessary rights and consents for the full period of any intellectual property rights to use the winner’s photograph, voice, likeness and/or image, and the name and age of the winner in any media without further payment or permission, for any future promotional activity.

20. The Promoter reserves the right to modify, suspend, cancel or terminate the competition for any reason, extend or resume the entry period, or change or withdraw the Prize at any time without giving advance notice and will do so if an event occurs that renders the competition itself or the awarding of the Prize impossible due to reasons beyond the control of the Promoter (including without limitation reasons which are unforeseeable by the Promoter at the time of running the competition) or if it cannot be guaranteed that the competition can be carried out fairly or correctly for technical, legal or other reasons and the entrant agrees that no liability shall attach to the Promoter as a result thereof.

21. The Promoter has arranged the competition in good faith but, to the fullest extent permitted by law, accepts no responsibility for and will not be liable for any claims, costs, losses, damages, expenses or liabilities, of any kind (including without limitation direct, indirect, consequential, incidental or punitive damages) arising out of or in connection with the competition or with the acceptance, possession, use or any other aspect of any prize awarded. Your legal rights as a consumer are not affected. Nothing in these Terms and Conditions limits or excludes the liability of the Promoter for death or personal injury resulting from the Promoter’s negligence or for any damage or liability incurred by the entrant as a result of fraud or fraudulent misrepresentation by the Promoter or otherwise as prohibited by law.

22. These Terms and Conditions are governed by English law and the Promoter and the entrant hereby submit to the exclusive jurisdiction of the English Courts.

Schedule 1 – Details of the Prize

  1. Prize
    1. The Prize supplier is with the Promoter’s The Moorings brand.The Prize is a 6-night Moorings power charter aboard a 40PC or 43PC in the British Virgin Islands, departing between October 2024 and September 2025. The Prize excludes peak dates: 21st November 2024 to 1st December 2024, 19Dec24-05Jan25, 1Jun25-31Jul25. Friday – Sunday starts are excluded. The Prize may not be booked to depart at any point outside of this time.The Prize includes the turnaround fee, fuel, watertoys (2 x Stand up paddleboards), transfers to and from the airport to the main Moorings base, and the Yacht Damage Waiver, as defined in the Booking Conditions.
    1. The winner is responsible for arranging (and bearing the costs of) any element of the trip that is not expressly described in paragraph 1.3 and, if applicable, paragraph 1.4 of this Schedule 1 above, which shall include (without limitation):
      1. transfers and travel;
      1. any hotel accommodation or other pre- / post- charter accommodation;
      1. taxes;
      1. Cruising taxes and permit
      1. Skipper/Skipper provisioning/Skipper gratuity
      1. gratuities;
      1. airport taxes imposed at the destination;
      1. insurance, visas or other travel documentation;
      1. vaccinations, where required; and
      1. events, activities, food and drink.
